Terms and Conditions


These Terms and Conditions outline the rules and regulations for the sale of products offered by the online store operating at www.metafor.pl, owned by Metafor Wojciech Mierzwa, located at Władysława Wagnera 12/24, 81-578 Gdynia, Poland, engaged in the production and sale of furniture products and specialized design services.
The company is registered with REGON: 260767881 and VAT number: 6642131882 (VAT EU: PL6642131882).


§ 1 Definitions


When mentioned in these Terms and Conditions:

  1. Metafor – A business entity involved in the production, import, and sale (both retail and wholesale) of products, operated by Wojciech Mierzwa, with a registered office at Władysława Wagnera 12/24, 81-578 Gdynia, Poland. Contact details: Email: wo.mierzwa@metafor.pl, Phone: +48 535 887 112. Bank account for PLN transfers: PL 80 1050 1432 1000 0091 4726 1110, SWIFT code: INGBPLPW.

  2. Store/Service – The online store operated by Wojciech Mierzwa, available at www.metafor.pl, through which Metafor Wojciech Mierzwa provides services as described in these Terms and Conditions.

  3. Terms and Conditions – These Terms and Conditions of the online store www.metafor.pl.

  4. Service – Mail-order sales of interior furnishing products conducted within and outside the Republic of Poland, executed upon placing an order by the Customer.

  5. Seller – Metafor Wojciech Mierzwa, VAT number 6642131882.

  6. Customer – An entity with full legal capacity, using the services of the Seller and entitled to receive the ordered products.

  7. Agreement – A sales agreement concluded between the Seller and the Customer, whereby the Seller commits to providing the Service, and the Customer agrees to pay the previously agreed price and accept the product.

  8. Delivery Service – A specialized entity responsible for delivering courier parcels. The Seller collaborates with courier and transport companies.

§ 2 General Provisions

  1. The Seller communicates with the Customer via the contact form available on www.metafor.pl, email, or phone. The Seller's contact details are specified in § 1. The cost of the call is in accordance with the telecommunications service provider's rates used by the Customer.

  2. The Customer uses the Seller's Services through the online store www.metafor.pl.

  3. Each product offered in the Store is brand new and comes with a manufacturer's warranty.

  4. The Seller is obligated to deliver a product free of defects.

  5. The Store's website is maintained in Polish.

  6. Each price indicated for a product is a gross price, including VAT.

  7. After the Customer places an order, the price cannot be changed.

  8. The Seller reserves the right to change the prices of goods offered in the Store only before the Customer places an order.

  9. The Seller may expand the Store's offer by adding new products without informing the contractors and customers whose orders are being processed or have been completed.

  10. The Seller may introduce price reductions and promotions. Some promotions are implemented through discount codes provided by the Seller on the Service, subject to § 2, point 11.

  11. In promotional or discounted sales, the quantity of goods and the duration of the promotion or discount are limited, and orders are processed in the order they are placed. The promotion or discount ends when the stock is exhausted or at a time specified by the Seller. The Seller will inform about the introduction or end of a promotion or discount and its duration through the Store.

  12. By placing an order, the Customer enters into an Agreement with the Seller as mentioned in § 1, point 8.

  13. The Seller issues a receipt or VAT invoice for each order to confirm the Agreement. The receipt or invoice is sent electronically without the need to attach a printed invoice to the shipment. Upon request, the Seller issues a VAT invoice, which can also be included with the product, sent by mail, or emailed.

  14. The Customer agrees to receive sales documents, including VAT invoices, electronically.

  15. The Seller adheres to the applicable code of good practice in its activities, in accordance with the Act of August 23, 2007, on counteracting unfair market practices.

§ 3 Placing Orders

  1. The Customer places an order through the Store at www.metafor.pl.

  2. To place an order, the Customer must click the "Place Order" button after selecting the product.

  3. After clicking "Place Order," the Customer must provide the following information: a) First Name b) Last Name c) Email Address d) Contact Phone e) Street f) Building Number g) Apartment Number h) Postal Code i) City j) Country k) Region Optionally, for a VAT invoice: l) Company Name m) VAT Number

  4. Providing personal data and continuing the purchase is equivalent to declaring that the provided data is true and accepting the site's privacy policy regarding the storage, handling, and processing of personal data.

  5. The Customer indicates whether they want to receive a VAT invoice. This can be done through an additional note in the order form. If the Customer orders a VAT invoice, they must provide the company name and VAT number for the invoice.

  6. A Customer registered as a VAT-UE payer can request a 0% VAT invoice. This prevents payment through the Service. After the Customer continues the purchase, the Seller will receive their address data. The Seller will verify the Customer's data and contact them within 5 business days to finalize the order or notify them of any discrepancies.

  7. If the order address is outside the EU member states, Switzerland, or Norway, payment cannot be made through the Service. After the Customer continues the purchase, the Seller will receive their address data, determine the cost and delivery time, and contact the Customer within 5 business days to finalize the order.

  8. After providing the data specified in § 3, point 3, the Customer can continue the purchase by clicking "Continue" or "Proceed." Except for the situations described in § 3, points 6 and 7, the Customer will be informed about the shipping costs. Except for the aforementioned situations, the Customer can choose a payment method: via STRIPE or traditional bank transfer after clicking "Continue" again.

  9. After selecting the payment method, the Customer completes the purchase by placing the order.

  10. The Seller reserves the right to further verify the order via email or phone contact within 5 business days after the order is placed. Additionally, the Seller reserves the right not to fulfill the order if the Customer has provided incomplete or false data as specified in § 3, point 3, and will inform the Customer if possible.

  11. The Customer is obligated to make the payment after clicking "Place Order."

  12. In the situation mentioned in § 3, point 10, sentence 2, the Seller will refund the paid amounts within 7 days from the day the information about the inability to fulfill the order is communicated to the Customer.

  13. The order is accepted for processing upon the Seller's receipt of confirmation of positive authorization from the payment system.

  14. If, after the Customer places an order, the Seller finds that the ordered product is unavailable, the Seller will promptly inform the Customer via email or phone. In such a situation, the Customer can withdraw from the Agreement, and the funds transferred to the Seller will be refunded within 7 days from the day the Seller receives information about the withdrawal. The Customer can also agree to fulfill the order at a time individually agreed with the Seller.

§ 4 Payments

  1. The Customer must make the payment for the ordered product after placing the order.

  2. The Customer makes the payment for the ordered product: a) By bank transfer or credit card. b) By direct transfer to the Seller's bank account for PLN settlements. Account number: IBAN PL 80 1050 1432 1000 0091 4726 1110, SWIFT code: INGBPLPW, maintained by ING Bank Śląski S.A. c) Through the online payment platform - STRIPE. d) Through the online payment platform - PAYPAL.

  3. The price indicated at the stage of choosing the payment system is the final price, including VAT and shipping costs, except for the situations described in § 3, points 6 and 7.

  4. International shipments can only be paid by bank transfer or credit card via STRIPE, through the online payment platform – PayPal, or by traditional bank transfer.

§ 5 Shipping Costs and Delivery Times

  1. Each product has an assigned order processing time. The order processing time is specified in business days and is counted from the day the payment is credited to the Seller's account to the day the ordered products are shipped.

  2. If the Customer orders products with different processing times, the longest time applies.

  3. The delivery time is the sum of the order processing time and the shipping time.

  4. Delivery times are as follows: a) Courier within Poland – up to 21 business days. b) Courier outside Poland within the European Union – 34 business days. c) Courier outside the European Union – individually determined.

  5. The Customer bears the shipping costs within the EU unless stated otherwise in the promotion.

  6. The Customer bears the shipping costs outside the EU.

  7. The shipping cost is calculated and displayed during the order process.

§ 6 Customer Obligations

  1. The Customer must: a) Provide true and accurate personal data. b) Comply with these Terms and Conditions. c) Make timely payments. d) Collect the ordered product upon delivery.

  2. The Customer is responsible for any inaccuracies or mistakes in the provided data.

§ 7 Withdrawal from Agreement

  1. The Customer has the right to withdraw from the Agreement without providing a reason within 14 days from the date of delivery.

  2. To withdraw from the Agreement, the Customer must notify the Seller in writing or electronically.

  3. The Customer must return the product within 14 days of withdrawal.

  4. The Seller will refund the payment within 7 days of receiving the returned product.

  5. The return shipping cost is borne by the Customer.

§ 8 Complaints and Warranty

  1. The Seller is responsible for any product defects.

  2. Complaints must be submitted in writing or electronically.

  3. The Seller will respond to the complaint within 14 days.

  4. If the complaint is accepted, the Seller will repair, replace, or refund the product.

  5. The warranty period is 24 months.

§ 9 Final Provisions

  1. The Seller reserves the right to change these Terms and Conditions.

  2. Changes will be communicated to the Customer 14 days before they take effect.

  3. Orders placed before the changes will be processed under the previous Terms and Conditions.

  4. Polish law applies to these Terms and Conditions.

  5. Disputes will be resolved by the competent court in Poland.
